The first and arguably most important thing it does is to place new safety requirements based on computing power. Models trained with 10 to the 26th power floating point operations, or flops, are subject to the rules. That’s beyond the computing power required to train the current frontier models, including GPT-4, but should pertain to the next-generation models from OpenAI, Google, Anthropic, and others.

Far from perfect, but AI is being regulated at the right time. The government has learned its lesson from the social media era, when its near-total inattention to hyper-scaling global platforms made it vulnerable to being blindsided by the inevitable harms once they arrived.

Leaders of the venture capital firm Andreessen Horowitz, as well as the founders of artificial intelligence companies Mistral, Hugging Face and Perplexity, asked President Joe Biden to clarify his stance on open-source models days after the administration published its long-awaited AI executive order.

In the letter to Biden, the venture capital and business leaders argued that the executive order could inadvertently hamstring the open-source AI community because of its loose definition of “dual use foundation models.” Requiring open-source startups to comply with the new and complicated reporting requirements would stifle innovation and benefit incumbents, they said.

The group also encouraged the Biden Administration not to deviate from the federal government’s long-term stance on open-source technology, which they described as a core reason the internet has “succeeded far beyond our imagination.” “Open source ensures that the AI era is both inclusive and just,” they added.
