I think the overall problem is that we are in a new creative space by which we don't have language for yet.
There is no 'artist' in this post-humanist AI age, it is a mashup or plurality of processes - human imagination > synthesis > composability
generative technology is changing the game to something we have not processed yet as a culture. IP or copyright makes no sense in this new age - I actually think all AI art should fall under CC0 - public domain.

A training model “opt-in” is a nice idea, but to what end? And enforced how?
If one artist opts out, but then a collective of open-source-advocate artists create a suite of hand-made pieces “in the style of” the opted-out artist… and then submits THOSE pieces to the ethical model… is that morally acceptable? Can we even police that?? They’re hand made after all…
This speaks to the underlying problem with the “protectionism” argument. Namely, that ALL creators have influences. Machine learning models have influences. Human artists have influences. And BOTH swirl these influences around in a vortex of computation to generate “new” art. Yet we label one “good.” And one “bad.”
I can empathize with artists who are losing ground. It’s not like they’ve had it easy to begin with… but the last thing we need is some arcane ethical framework to police how people express themselves. It’s an especially bad look for artists in my opinion. For champions of creativity… to be finger wagging at such an empowering creative technology.
This isn’t Skynet after all. It’s a paintbrush that knows how to paint. It’s AWESOME.

Good to begin having this conversation. However, like with music being downloaded without paying the original artists, I think it's a losing battle.
